被欺侮

根据州法律, individuals and/or organizations engaging in hazing could be subject to fines and charged with a criminal offense. 在HPU政策下, individuals and/or organizations engaging in hazing may be subject to disciplinary sanctions including expulsion.

“质押人”指任何被, 是否在考虑加入, 或者正在申请某个组织的会员资格. 

“Pledging” means any action or activity related to becoming a member of an organization. 

“学生”是指具备以下条件的任何人:
A)在某一教育机构注册或就读;
B) has been accepted for admission at the educational institution where the hazing incident occurs;  or
C)  intends to attend an educational institution during any of its regular sessions after a period of scheduled vacation.

“组织”指的是兄弟会, 女学生联谊会, 协会, 公司, 订单, 社会, 队, 俱乐部, 或者学生会, 乐队、音乐团体或学者, 运动, 啦啦队, 或者是舞蹈队, including any group or team that participates in National Collegiate Athletic Association competition, 或者一项服务, 社会, 或者类似的群体, 哪些成员主要是学生.

“欺侮”是指任何故意的, 知道, 或者鲁莽的行为, 发生在教育机构校园内或校园外的, 由一个人单独或与他人合作, 以宣誓为目的而针对学生的, 被引入, 加入到, 在…任职, 或维持一个组织的成员资格,如果行为:
A)任何形式的身体暴力, 比如鞭打, 打, 引人注目的, 品牌, 电子令人震惊, 在身体上放置有害物质的, 或类似的活动;
B)涉及睡眠剥夺, 暴露在环境中, 禁闭在一个小空间里, 健美操, or other similar activity that subjects the student to an unreasonable risk of harm or that adversely affects the mental or physical health or safety of the student;
C,涉及到食物的消耗, 液体, 酒精饮料, 酒, 药物, 或者其他物质, (E)段所述以外的情况, that subjects the student to an unreasonable risk of harm or that adversely affects the mental or physical health or safety of the student;
D)是任何诱导的活动, 原因, or requires the student to perform a duty or task that involves a violation of the 刑法; or
E)包括第1节所定义的强迫.07, 刑法, the student to consume: a 药物; or an 酒精饮料 or 酒 in an amount that would lead a reasonable person to believe that the student is intoxicated, 如第49条所定义.01、刑法典.

根据法律, 一个人不仅可以通过参与欺侮活动来犯欺侮罪, 但也通过招揽, 导演, 鼓励, 协助, or attempting to aid another in hazing; by intentionally, 故意, or recklessly allowing hazing to occur; or by failing to report in writing to the Dean of Students knowledge that a hazing incident is planned or has occurred (see Sec. 37.152).

An organization commits a hazing offense if the organization condones or encour年龄s hazing or if an officer or any combination of members, 承诺, or alumni of the organization commits or assists in the commission of hazing (see Sec. 37.153).

A person’s consent to a hazing activity does not legalize and or legitimize the activity (see Sec. 37.154)

A)在对本分章规定的犯罪的起诉中, the court may grant immunity from prosecution for the offense to each person who is subpoenaed to testify for the prosecution and who does testify for the prosecution.
B)  Any person who voluntarily reports a specific hazing incident involving a student in an educational institution to the dean of students or other appropriate official of the institution is immune from civil or criminal liability that might otherwise be incurred or imposed as a result of the reported hazing incident if the person: reports the incident before being contacted by the institution concerning the incident or otherwise being included in the institution’s investigation of the incident; and as determined by the dean of students or other appropriate official of the institution designated by the institution, 在有关该事件的任何机构程序中真诚合作.
C)  Immunity under Subsection (b) extends to participation in any judicial proceeding resulting from the report.
D)  A person is not immune under Subsection (b) if the person: reports the person’s own act of hazing; or reports an incident of hazing in bad faith or with malice.

The law does not affect or in any way restrict the right of the University to enforce its own rules and/or penalties against hazing.

Howard Payne provides an anonymous hazing submission form for students to report hazing incidents to the Director of 学生活动.

The form below will permit you to confidentially submit reports regarding incidents you believe to be hazing. A submitted report may result in an investigation by 学生活动 into the alleged hazing incident. Every attempt will be made to keep all information submitted in this form confidential.

WARNING: False reports impede the ability of 学生活动 to conduct investigations of legitimate hazing incidents. Knowingly submitting a false report of hazing or misuse of this University form will result in disciplinary action.

You can also report incidents of alleged hazing directly to the Office of 学生的经验 in the Mabee University Center, 2号楼.
